1. Definitions

For the purposes of these General Terms and Conditions, the following definitions apply:

DNA Care: The DNA Care practice, located at Kerkweg 2C, 1906 AW Limmen, the Netherlands, registered with the Dutch Chamber of Commerce under number 62936972 and available at info@dnacare.nl and 072 – 743 63 53. DNA Care provides services in the areas of Functional Medicine, lifestyle, preventive health, interpretation of functional and/or genetic laboratory testing, supplement recommendations, and related guidance.

Client: Any individual who uses DNA Care’s services, books a consultation, participates in a program, requests laboratory testing, or otherwise enters into an agreement with DNA Care.

Services: All services provided by DNA Care, including in-person and online consultations, intake consultations, programs, analysis of intake forms, interpretation of laboratory testing, written recommendations, supplement and lifestyle recommendations, administrative processing of laboratory test requests, and other Functional Medicine guidance.

Agreement: Any appointment or engagement between DNA Care and the client, including a booked consultation, program, laboratory test request, interpretation of test results, or other agreed-upon service.

Laboratory testing: Functional, genetic, hormonal, gut microbiome, urine, saliva, blood, or other testing requested, processed, or discussed through DNA Care or at DNA Care’s recommendation.

External party: Any third party that may be involved in providing the services, such as laboratories, physicians, pharmacists, accountants, software providers, Zorgmail, payment service providers, website administrators, or other service providers.

2. Applicability, Acceptance, and Order of Precedence

  1. These General Terms and Conditions apply to all offers, appointments, consultations, programs, laboratory test requests, recommendations, documents, correspondence, and other services provided by DNA Care.
  2. By booking a consultation, requesting laboratory testing, completing an intake form, paying an invoice, signing an informed consent form, or entering into a Functional Medicine guidance program, the client confirms that they have read and accepted these General Terms and Conditions.
  3. Any deviation from these General Terms and Conditions is valid only if confirmed in writing by DNA Care.
  4. If one or more provisions of these General Terms and Conditions are found to be wholly or partially invalid or unenforceable, all remaining provisions will remain in full force and effect. In that event, the parties will apply a replacement provision that corresponds as closely as possible to the purpose and intent of the original provision.
  5. Information on the website is intended for general informational purposes. No rights may be derived from general information on the website if different individual arrangements have been agreed upon in writing.

3. Nature of the Services

  1. DNA Care provides guidance based on a Functional Medicine approach. This approach may include consideration of lifestyle, nutrition, physiological and environmental stressors, capacity for recovery, medical history, laboratory results, supplementation, genetic predisposition, epigenetic factors, and other factors that may be relevant to health and well-being.
  2. DNA Care’s services focus on education, analysis, preventive health, lifestyle optimization, supporting the body’s capacity for recovery, and complementary Functional Medicine guidance.
  3. Roos van der Blom is a Functional Medicine practitioner. She is not a physician.
  4. DNA Care does not make medical diagnoses in the capacity of a physician and does not treat acute medical conditions.
  5. DNA Care may discuss signs, patterns, and possible underlying factors from a Functional Medicine perspective. This does not replace conventional medical diagnosis or treatment.
  6. The client remains responsible for seeking and continuing to follow appropriate conventional medical care.

4. Not a Substitute for Conventional or Emergency Medical Care

  1. The client understands that DNA Care’s guidance is complementary to conventional medical care and can never serve as a substitute for such care.
  2. DNA Care’s consultations, analyses, and recommendations never replace medical evaluation, diagnosis, treatment, or guidance provided by a primary care physician, medical specialist, pharmacist, psychologist, or other conventional healthcare professional.
  3. The client is advised to always discuss symptoms, diagnoses, medical questions, medication use, and changes in health with their primary care physician or treating physician.
  4. DNA Care never advises clients to independently start, stop, increase, decrease, or otherwise change prescribed medication, medical treatment, or therapy without first consulting the prescribing or treating physician.
  5. Decisions concerning diagnosis, medication, dosage, medical treatment, or specialist care always remain the responsibility of the treating physician or medical specialist.
  6. If DNA Care identifies signs that require conventional medical evaluation, DNA Care may advise the client to contact their primary care physician, specialist, pharmacist, or another healthcare professional.
  7. DNA Care does not provide emergency or urgent medical care. In the event of acute symptoms, warning signs, or another emergency, the client must immediately contact their primary care physician, the after-hours general practitioner service, 112, a medical specialist, or their treating physician.

5. Contraindications and Safety

  1. Guidance from DNA Care may not be appropriate, or may require prior consultation with a physician, in the event of:
    • serious psychiatric conditions or an acute mental health crisis;
    • complex medication use when the safety of complementary guidance cannot be adequately assessed;
    • circumstances in which lifestyle changes would not be medically or psychologically advisable;
    • acute, unstable, or seriously progressive medical symptoms or conditions;
    • conditions or requests for assistance that fall outside DNA Care’s expertise or scope of practice.
  2. If DNA Care determines that guidance is inappropriate or unsafe, this will be carefully discussed with the client.
  3. DNA Care may decline to accept a client, reschedule a consultation, and/or suspend guidance if, in DNA Care’s professional judgment, continuing would not be responsible, appropriate, or safe.
  4. Whenever possible, DNA Care will assist the client in considering appropriate next steps or a referral to conventional medical care or another healthcare provider.

6. No Guarantee of Results

  1. DNA Care will make reasonable efforts to guide the client carefully, professionally, and to the best of its knowledge and professional judgment.
  2. Health and recovery depend on numerous factors, including medical history, the nature, duration, and severity of symptoms, medication use, lifestyle, individual capacity, genetic predisposition, capacity for recovery, adherence to recommendations, and external circumstances.
  3. DNA Care makes no guarantees or commitments regarding improvement, recovery, symptom reduction, improved laboratory values, hormonal balance, fertility, pregnancy, changes in weight, increased energy, or any other specific outcome.
  4. Failure to achieve the outcome desired by the client does not entitle the client to a refund of consultation fees, program fees, laboratory costs, interpretation fees, or fees paid for other services.

7. Client Responsibilities, Disclosure of Information, and Cooperation

  1. The client is responsible for providing, fully, accurately, and in a timely manner, all information that may be relevant to appropriate and safe guidance.
  2. This information includes, but is not limited to, symptoms, medical history, diagnoses, medication use, supplement use, allergies, pregnancy, plans to conceive, breastfeeding, surgical procedures, treatment by other healthcare providers, previous examinations, and laboratory results.
  3. If relevant information is not provided or is provided inaccurately, incompletely, or too late, DNA Care cannot be held responsible for any resulting consequences.
  4. If information is not provided on time or is incomplete, this may affect the depth or scope of the consultation or may give DNA Care grounds to reschedule the appointment.
  5. The client is responsible for deciding whether or not to follow DNA Care’s recommendations.
  6. DNA Care may suspend or modify a consultation, Functional Medicine program, or recommendation if necessary information is missing, the client’s safety cannot be adequately ensured, or the request falls outside DNA Care’s expertise, scope of practice, or capabilities.

8. Consultations, Preparation, and Programs

  1. A consultation does not consist solely of the consultation time itself. A significant part of DNA Care’s work is performed outside the scheduled consultation.
  2. This work may include the analysis of medical information, intake forms, symptom questionnaires, laboratory results, medical history, medication use, supplement use, and relevant medical correspondence.
  3. Preparation, consultation time, and analysis will be charged unless otherwise agreed upon in writing.
  4. Consultations may take place at the practice or in another agreed-upon manner, such as online.
  5. Online consultations take place through an appropriate digital platform selected by DNA Care. The client is responsible for ensuring a reliable internet connection, a quiet environment, and properly functioning equipment.
  6. If an online consultation cannot take place, or can take place only partially, due to technical issues on the client’s side, the payment obligation will generally remain in effect.
  7. A Functional Medicine program is tailored to the individual client. Its content may be modified during the program based on new information, laboratory results, individual capacity, medical developments, personal circumstances, or progress.
  8. Early termination of a Functional Medicine program does not entitle the client to a refund for work already performed, preparation, analyses, consultations, interpretations, or time reserved.
  9. If the client fails to respond for an extended period, does not attend appointments, fails to provide necessary information, or fails to meet payment obligations, DNA Care may suspend or terminate the Functional Medicine program.

9. Written Recommendations and Follow-Up

  1. If written follow-up, a recommendation plan, or further written elaboration is part of the agreed-upon service, the client will generally receive it through Zorgmail within a maximum of 10 business days after the consultation.
  2. Written recommendations are based on the consultation, the available information, and DNA Care’s professional assessment.
  3. Written recommendations are personal and intended exclusively for the client.
  4. If an invoice for work performed by DNA Care remains outstanding, DNA Care is entitled to suspend written follow-up until full payment has been received.
  5. Written recommendations are prepared based on the information available at that time. New medical information, new symptoms, new medication, or changed circumstances may require a recommendation to be reassessed or revised.

10. Laboratory Testing

  1. DNA Care may recommend, request, administratively process, or interpret laboratory testing.
  2. Laboratory tests are performed by external laboratories or providers.
  3. DNA Care is not responsible for errors, delays, shipping, processing, analytical methods, reporting, price changes, rejection of samples, or technical issues involving external laboratories or other third parties.
  4. The client is responsible for ensuring that samples are collected, stored, and shipped correctly in accordance with the relevant laboratory’s instructions.
  5. If a sample is collected incorrectly, shipped too late, lost, damaged, or rejected by the laboratory, any resulting additional costs will be the client’s responsibility.
  6. Laboratory results are always interpreted within the context of symptoms, medical history, medication use, supplement use, lifestyle, and other relevant factors, and within the scope of Functional Medicine.
  7. A laboratory result by itself does not constitute a complete diagnosis and does not replace conventional medical diagnosis or treatment.
  8. Functional or genetic laboratory testing may provide additional insights, but DNA Care cannot guarantee that such testing will produce clear or useful outcomes, or outcomes desired by the client.
  9. Extensive functional or genetic testing is subject to an additional fee for professional interpretation, in accordance with the fees listed on DNA Care’s website.
  10. No separate report regarding an extensive laboratory interpretation will be provided unless otherwise agreed upon in writing in advance. The findings will generally be discussed during a consultation and incorporated into the written recommendations.

11. Laboratory Test Requests for Non-Clients

  1. In certain circumstances, DNA Care may administratively request laboratory testing for individuals who are not DNA Care clients.
  2. In that event, the fee relates solely to the administrative processing of the request.
  3. The cost of the laboratory test itself will be charged separately by the laboratory.
  4. Interpretation, substantive explanation, medical advice, Functional Medicine recommendations, and written elaboration are not included.
  5. Administratively requesting laboratory testing through DNA Care does not automatically create a treatment or guidance agreement with DNA Care.
  6. If the individual requesting the test wishes to discuss the results with DNA Care, a consultation must be scheduled by mutual agreement.
  7. Extensive functional or genetic testing may be subject to additional interpretation fees in accordance with the fees listed on DNA Care’s website.
  8. For individual laboratory test requests made by non-clients, DNA Care is not responsible for follow-up, interpretation, medical assessment, or referral unless separate written arrangements have been made.

12. Supplements, Nutrition, Herbal Medicine, and Lifestyle Recommendations

  1. Recommendations concerning supplements, nutrition, herbal medicine, and lifestyle are prepared carefully based on the available information.
  2. The client is responsible for disclosing medication use, supplement use, pregnancy, plans to conceive, breastfeeding, allergies, surgical procedures, medical conditions, treatment by other healthcare providers, and all other information that may be relevant to DNA Care’s recommendations.
  3. The client must use supplements and follow recommendations only as advised and, in the event of uncertainty, contact DNA Care, their primary care physician, pharmacist, treating physician, or medical specialist.
  4. In the event of medication use, complex medical conditions, pregnancy, breastfeeding, or plans to conceive, DNA Care advises the client to always discuss supplementation and lifestyle changes with their treating physician, pharmacist, midwife, or medical specialist.
  5. DNA Care is not responsible for symptoms or side effects resulting from the client incorrectly following recommendations, independently modifying recommendations, combining recommendations with undisclosed medication or supplements, or failing to disclose relevant information.
  6. If the client experiences symptoms after starting supplements, dietary changes, herbal medicine, lifestyle changes, or other recommendations, the client must report this immediately. In the event of side effects or worsening symptoms, the client must pause their use and contact a physician or pharmacist when medically necessary.
  7. Supplements, herbal remedies, and other products are generally ordered by the client directly from external suppliers.
  8. DNA Care is not responsible for delivery, quality, price changes, availability, composition, product changes, package inserts, return policies, or the actions of external suppliers.

13. Medication and Prescription Requests

  1. DNA Care does not change, discontinue, or initiate medication without the involvement of the treating or prescribing physician.
  2. Questions concerning medication, dosages, side effects, medical diagnoses, medical treatment, or urgent symptoms must always be discussed with the client’s primary care physician, medical specialist, or pharmacist.
  3. DNA Care is not responsible for decisions made by prescribing physicians, pharmacists, or other healthcare providers.
  4. If consultation with a prescribing physician or pharmacist is required, this will generally take place only with the client’s consent, unless there is a legal obligation or compelling interest.

14. Fees, Payment, and Suspension of Services

  1. DNA Care’s current fees are listed on its website.
  2. Unless otherwise agreed upon in writing, online consultations and consultations requiring advance preparation must be paid no later than 48 hours before the consultation.
  3. The payment terms for laboratory test requests, interpretations, analyses, Functional Medicine programs, written follow-up, and other services are stated on the relevant invoice or written confirmation.
  4. If payment is not received on time, DNA Care is entitled to suspend preparation, the consultation, the laboratory test request, interpretation, written follow-up, or other work until full payment has been received.
  5. If payment remains outstanding after a reminder, statutory interest and reasonable collection costs may be charged from the final payment deadline provided.
  6. Any costs associated with laboratory testing, supplements, medication, medical aids, or consultations with other healthcare providers are not included in DNA Care’s fees unless expressly stated otherwise.
  7. The client is responsible for determining whether any costs are fully or partially reimbursed by a health insurer or are tax-deductible.
  8. DNA Care does not guarantee reimbursement by health insurers or tax deductibility. The absence of reimbursement or tax deductibility does not affect the client’s payment obligation to DNA Care.

15. Cancellation, Rescheduling, and Practitioner Coverage

  1. Appointments may be rescheduled or canceled free of charge up to 48 hours before the scheduled consultation.
  2. If an appointment is canceled or rescheduled within 48 hours before the consultation, 50% of the consultation fee will be charged.
  3. If an appointment is canceled within 24 hours before the consultation, or if the client fails to attend without notice, the full consultation fee will be due.
  4. If the client cannot be reached at the agreed-upon time for an online consultation, this will be considered a failure to attend, and the full consultation fee will remain due.
  5. Appointments must always be canceled or rescheduled by email.
  6. If DNA Care must reschedule a consultation due to illness, force majeure, or personal circumstances, a new appointment will be scheduled in consultation with the client.
  7. DNA Care has practitioner coverage arrangements in place. If the practitioner is temporarily unavailable, continuity of care will, to the extent necessary and appropriate, be provided by a qualified covering practitioner.
  8. In the event of DNA Care’s prolonged unavailability, an appropriate solution will be considered in consultation with the client. If the client wishes, and subject to availability, the possibility of transferring the client to a qualified colleague may be discussed.
  9. Information from the client’s records will be transferred only with the client’s written consent, unless otherwise required by law.

16. Communication and Availability

  1. Communication between DNA Care and the client takes place by email, Zorgmail, telephone, online consultation, or other communication channels used by DNA Care.
  2. The client’s use of email or Zorgmail is generally intended for practical communication, such as making, changing, or canceling appointments, submitting documents, or requesting tests.
  3. Substantive questions concerning care, the interpretation of symptoms or test results, and modifications to recommendations require careful assessment and will therefore be discussed during a consultation.
  4. Substantive questions requiring additional assessment, review of the client’s records, interpretation, or recommendations may be treated as a consultation or additional service and charged separately.
  5. DNA Care aims to respond to messages carefully and within a reasonable period but cannot guarantee immediate availability.
  6. Digital communication is not suitable for urgent medical situations. Please refer to Article 4, paragraph 7.
  7. The client is responsible for reading messages, invoices, instructions, and recommendations from DNA Care promptly and carefully.
  8. DNA Care is not responsible for consequences arising from the client’s failure to read messages, invoices, instructions, or recommendations, or from reading them late or incompletely.

17. Cooperation With External Parties

  1. When appropriate, and subject to paragraph 2 of this article, DNA Care may cooperate or coordinate with external laboratories, physicians, pharmacists, therapists, suppliers, accountants, software providers, Zorgmail, payment service providers, website administrators, or other involved parties.
  2. Substantive consultation with a physician, pharmacist, medical specialist, or other healthcare provider will take place only with the client’s written consent, unless there is a legal basis for doing so, including the party’s role as a co-treating healthcare provider, a legal obligation, or a compelling interest.
  3. DNA Care is not liable for the acts, omissions, recommendations, fees, products, services, reports, delays, preferred working methods, or errors of external parties.
  4. If the client contacts an external party at DNA Care’s recommendation, the acts or omissions of that external party fall outside the agreement between the client and DNA Care.

18. Privacy and Client Records

  1. DNA Care processes personal data and health data only to the extent necessary for performing the agreement, providing guidance, administration, invoicing, maintaining client records, communication, compliance with legal obligations, and quality-related purposes.
  2. Health data constitutes special-category personal data and is processed by DNA Care with appropriate confidentiality, care, and security.
  3. DNA Care processes personal data in accordance with DNA Care’s privacy policy, as published on its website.
  4. Within the limits of applicable law, the client has the right to information, access, correction, supplementation, a copy of their data, data portability, and, in certain circumstances, deletion or restriction of processing.
  5. DNA Care retains client records and health data in accordance with applicable statutory retention periods. Health data is generally retained for 20 years from the date of the most recent amendment to the record, unless another statutory period applies or longer retention is necessary for appropriate care.
  6. Administrative and tax-related information is retained in accordance with the applicable statutory retention periods.
  7. DNA Care does not disclose health data to third parties without the client’s express consent unless this is necessary for performing the agreement, required by law, or justified by a compelling interest.
  8. Further information about the processing of personal data, retention periods, security, and data-subject rights is provided in DNA Care’s privacy policy.

19. Intellectual Property and Recordings

  1. All documents, recommendations, schedules, texts, protocols, analyses, presentations, forms, emails, Zorgmail messages, reports, and other materials provided by DNA Care remain the property of DNA Care unless otherwise agreed upon in writing.
  2. The client may use these materials only for personal purposes.
  3. DNA Care materials may not be copied, disclosed, distributed, used commercially, modified, or provided to third parties without DNA Care’s written consent.
  4. DNA Care’s recommendations, protocols, or documents may not be used as treatment protocols, educational materials, commercial products, or advice for third parties.
  5. Video or audio recordings of consultations, conversations, lectures, workshops, or other meetings may not be made without DNA Care’s prior written consent.
  6. If consent to make a recording is granted, the recording is intended solely for the client’s personal use and may not be shared, published, edited, or distributed without DNA Care’s written consent.

20. Limits of the Services and Termination

  1. DNA Care may terminate its guidance and/or the agreement with the client if:
    • the client’s request does not, or no longer, fall within DNA Care’s expertise or scope of practice;
    • circumstances prevent safe or careful guidance;
    • there is insufficient willingness or ability to follow recommendations;
    • a workable professional relationship or mutual trust no longer exists;
    • the physical, emotional, or practical burden is so significant that continuing is considered inadvisable;
    • the client engages in transgressive, intimidating, aggressive, or inappropriate behavior;
    • payment obligations are not met;
    • the client repeatedly fails to provide necessary information, provides such information incompletely or too late, or fails to attend appointments.
  2. In the event of aggression, threats, intimidation, transgressive behavior, repeated inappropriate conduct, or misuse of communication channels, DNA Care may address the client’s conduct and issue a warning.
  3. In the event of repeated or serious transgressive behavior, DNA Care reserves the right to unilaterally terminate the guidance or professional relationship due to a breakdown of trust.
  4. The client remains obligated to pay for consultations, tests, preparation, interpretations, and services already performed or provided.
  5. When appropriate, DNA Care will advise the client about possible next steps or referral to conventional medical care or another healthcare provider.

21. Liability

  1. DNA Care performs its work carefully and to the best of its professional knowledge and judgment.
  2. DNA Care is not liable for damages arising because the client provided inaccurate, incomplete, or outdated information; failed to follow recommendations or followed them incorrectly; independently modified recommendations; or failed to seek conventional medical assistance in a timely manner.
  3. DNA Care is not liable for damages resulting from the services, products, supplements, laboratory tests, recommendations, reports, delays, or actions of external parties.
  4. DNA Care is not liable for damages resulting from technical issues, disruptions to digital communications, email problems, internet outages, or messages not being received.
  5. DNA Care is not liable for indirect or consequential damages, loss of income, loss of anticipated savings, emotional harm, or damages caused by delay.
  6. If DNA Care is found liable, its liability will be limited to the amount paid by the client for the relevant service or to the amount paid under the applicable professional or business liability insurance policy.
  7. These limitations of liability do not apply to the extent that they are prohibited by mandatory law.

22. Complaints Procedure

  1. DNA Care considers client satisfaction with its guidance important and encourages clients to raise any concerns as soon as possible.
  2. Complaints may be submitted in writing using DNA Care’s contact information.
  3. DNA Care will handle the complaint carefully and make reasonable efforts to reach an appropriate solution together with the client.
  4. If this does not result in a satisfactory outcome, the client may use the complaints and disputes procedure provided through MBOG: https://mbog.nl/over-mbog/klachten-en-geschillen/
  5. At the client’s request, DNA Care will provide the contact information of the complaints officer and/or dispute resolution body through Zorgmail.
  6. Submitting a complaint does not suspend the client’s payment obligations unless otherwise agreed upon in writing.

23. Force Majeure

  1. DNA Care is not required to fulfill its obligations if prevented from doing so by force majeure.
  2. Force majeure includes, but is not limited to, illness, personal emergencies, death or serious illness in the practitioner’s personal circle, technical malfunctions, internet outages, government measures, pandemics, fire, theft, power outages, problems involving external laboratories, problems involving digital systems, or other circumstances beyond DNA Care’s reasonable control.
  3. In the event of force majeure, DNA Care will make reasonable efforts to offer an appropriate solution, such as rescheduling a consultation.
  4. Force majeure does not give rise to any right to compensation.

24. Amendments to the General Terms and Conditions

  1. DNA Care reserves the right to amend these General Terms and Conditions.
  2. The most recent version of the General Terms and Conditions will be made available through the website or provided upon request.
  3. Ongoing agreements are governed by the General Terms and Conditions in effect when the agreement was entered into, unless otherwise agreed upon in writing or an amendment is necessary due to applicable laws or regulations.

25. Governing Law and Disputes

  1. All agreements between DNA Care and the client are governed by Dutch law.
  2. The parties will preferably seek to resolve disputes through mutual consultation.
  3. If a dispute cannot be resolved through consultation, it will be submitted to the recognized dispute resolution body with which DNA Care is affiliated.

26. Final Provision

These General Terms and Conditions are intended to provide clarity regarding DNA Care’s working methods, responsibilities, and the mutual expectations of DNA Care and the client.

DNA Care is committed to a careful, respectful, and professional working relationship centered on transparency, integrity, safety, expertise, confidentiality, and personal responsibility.
